These Terms of Service (“Terms”) govern your access to and use of the website located at LandscapingLexingtonSC.com and any related services (collectively, the “Site” and “Services”), operated by the owner of LandscapingLexingtonSC.com (“we,” “us,” “our,” or the “Company”). By accessing or using the Site, submitting a request through it, or otherwise engaging our Services, you (“you,” “user,” or “customer”) agree to be bound by these Terms. If you do not agree, do not use the Site.

1. Description of Services

The Site operates as a landscaping directory and lead-generation service for the Lexington, South Carolina area and surrounding communities. Through the Site, users may submit information requesting landscaping, lawn care, hardscaping, and related services. We may, at our sole discretion:

• Connect you with one or more independent third-party landscaping contractors or service providers (“Contractors”); and/or
• Perform the requested work ourselves or through affiliates we designate.

We do not guarantee that any particular Contractor will contact you, that work will be performed within any specific timeframe, or that any specific outcome will result from submitting a request. The Site is a facilitation and referral platform, not a party to the actual service agreement between you and any Contractor (except where we directly perform the work).

2. Lead Generation and Information Sharing

By submitting a request, inquiry, or form through the Site, you expressly acknowledge and consent that the information you provide — including your name, address, phone number, email, and details about the services you seek — constitutes a “lead” that we may collect, use, sell, resell, license, or otherwise transfer to one or more third-party Contractors for the purpose of contacting you about their services.

You further acknowledge and agree that:

• We may share your lead with multiple Contractors simultaneously, and more than one Contractor may contact you.
• We may receive compensation, referral fees, or other consideration from Contractors in exchange for leads or completed transactions.
• Contractors are independent businesses over whom we exercise no control regarding pricing, scheduling, quality, licensing, or conduct.
• By submitting your contact information, you consent to being contacted by us and by Contractors via phone call, text message (SMS), and email, including through automated dialing systems where permitted by law, even if your number is listed on a Do-Not-Call registry. Message and data rates may apply. You may opt out at any time by following the instructions in Section 10.

3. No Endorsement or Guarantee of Contractors

We do not employ, endorse, recommend, guarantee, or vouch for any Contractor listed in or contacted through our directory. Any listing, referral, or connection is provided for informational and convenience purposes only. We make no representation or warranty regarding any Contractor’s licensing, insurance, bonding, qualifications, workmanship, pricing, or reliability. You are solely responsible for vetting any Contractor, verifying their credentials and insurance, negotiating terms, and satisfying yourself as to their suitability before engaging them.

4. Work Performed Directly by the Company

Where we perform landscaping or related work directly rather than referring you to a Contractor, a separate written estimate, quote, or service agreement will govern the specific scope, price, and terms of that work. In the event of a conflict between such a written service agreement and these Terms, the written service agreement controls with respect to that work. Nothing on the Site constitutes a binding offer to perform work at any stated price until confirmed in writing by us.

5. User Obligations and Accurate Information

You agree to provide accurate, current, and complete information when using the Site and to have the legal authority to authorize work at the property address you submit. You agree not to use the Site for any unlawful, fraudulent, or abusive purpose, not to submit requests on behalf of others without authorization, and not to interfere with the proper functioning of the Site.

6. Payments and Disputes

Any payment for services performed by a Contractor is a matter solely between you and that Contractor. We are not responsible for collecting payment, issuing refunds, or resolving disputes relating to work performed by Contractors. Disputes regarding Contractor work must be directed to the Contractor. Where we perform work directly, payment and refund terms will be set out in our written service agreement with you.

7. Disclaimers of Warranties

THE SITE AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY LEAD WILL RESULT IN CONTACT, A QUOTE, OR COMPLETED WORK.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL THE COMPANY, ITS OWNER, AFFILIATES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR PROPERTY DAMAGE, ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE, ANY LEAD, OR ANY WORK PERFORMED BY A CONTRACTOR. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US DIRECTLY IN THE SIX MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100). THIS LIMITATION DOES NOT APPLY TO WORK WE PERFORM DIRECTLY TO THE EXTENT A SEPARATE SERVICE AGREEMENT PROVIDES OTHERWISE, AND IT DOES NOT LIMIT LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW.

9. Indemnification

You agree to indemnify, defend, and hold harmless the Company and its owner, affiliates, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Site, your violation of these Terms, or your interactions or agreements with any Contractor.

10. Communications and Opt-Out

By providing your contact information, you consent to receive communications from us and Contractors as described in Section 2. To stop text messages, reply “STOP” to any message. To stop emails, use the unsubscribe link in any email or contact us using the details below. To request that we cease sharing your information with Contractors, contact us using the details in Section 16. Opting out will not retroactively recall information already shared.

11. Privacy

Our collection and use of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference. By using the Site, you consent to the practices described there, including the sharing and sale of lead information to Contractors.

12. Intellectual Property

All content on the Site, including text, graphics, logos, and the LandscapingLexingtonSC.com name, is owned by or licensed to the Company and is protected by applicable intellectual property laws. You may not copy, reproduce, scrape, or redistribute Site content without our prior written permission.

13. Third-Party Links

The Site may contain links to third-party websites or resources. We are not responsible for the content, products, or practices of any third party, and inclusion of a link does not imply endorsement.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of South Carolina, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Site that is not resolved informally will be subject to the exclusive jurisdiction of the state and federal courts located in Lexington County, South Carolina, and you consent to venue and personal jurisdiction there.

15. Changes to These Terms

We may modify these Terms at any time by posting an updated version on the Site with a revised “Last Updated” date. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
